It might just be because they have to finish the ass effect trilogy (I doubt they'll put DA in the back seat since genericfantasy is supposed to be their speciallty). Maybe once that is done they'll make a sequel. If not, it probably was just PR talk.

Game rules are not copyrightable. Look at KOTC.

Setting is a part of author expression. However they made game that was supposed to be used as a base for creation of RPG stories... Basically they gave up rights for any game based on these settings as long as it has significant part of its own artwork. Basically as long as it's not a copy and paste, they allowed it because they published rulebook. They still retains right for making books and similar stuff.

False. KoTC used the Open Game Licensed 'D20' system which WoTC gives express permission to use(with restrictions). D20 is not D&D so you can't use anything specific to D&D(as opposed to stuff that is found in both D20 AND D&D) when creating your own game.

If you don't believe game systems are copyrightable then try making a CRPG that uses the Champions or GURPS rule systems and see how quickly you get a cease and desist order.

I wouldn't mind a properly done open world game set in the pre-4th ed. Forgotten Realms setting. Key word here is "properly". At best, if anyone ever did it, it'd just be shitty Oblivion wannabe. Would be nice if it were a less-shitty Risen wannabe, though.

JE sold well. It sold between 1.5-2mil copies but with BIO's track record it was under par since their top games sell between 2.5-3mil (until ME2 and DA broke the 3mil barrier).

I doubt JE is getting a sequel anytime soon since it only sold half of what the newer games did.

Why make a JE2 which will sell 2mil copies when you can, instead, make a DA3 that will sell 3mil copies.

An open-world, low magic FR (or other D&D setting) cRPG would be nice. Won't happen.

Icewind Dale III will actually be a Skyrim spinoff in Gamebryo: recycle the snow-covered art assets and voilà. Single-character, D&D action-RPG -- how could it fail?

The only way to make this a proper Icewind Dale without 2D backgrounds, would be to hire the same people who did the environments for Guild Wars. Everything else would be banal and boring shit, pissing on the legacy of this excellent series.

I believe that the issue of copyrighting rpg rules has been tested in court and that the court decided (here in the US anyway) that the mechanics are not copyright, only the words used to describe them. The case involved the BRP (basic role-playing) system used in runequest, call of cthulu etc. and Chaosium v. Games Workshop (or Avalon Hill?) I believe.

So if you avoid using their language to describe the rules (or black box it to demonstrate to the courts that copying them was impossible) you should be good. (unless a modern court overrules the precedent of a case from the '80s, which might be common, I'm no lawyer.)

Settings like Dark Sun however, even if now unsupported (though their is a 4th ed. Dark Sun, so let's say Planescape) are still their IP, at least for 100 years or whatever it is now.
